Welcome to CommonsHarborLine ("we," "us," or "our"). Your use of our yacht charter services and our website at commonsharborline.sbs (the "Service") is subject to these Terms & Conditions ("Terms").
Your reservation of a charter or use of our Service implies your acceptance of these Terms. If you do not consent to any part of these terms, you should not use the Service.
2. Service Overview
CommonsHarborLine offers luxury yacht charter services that include but are not limited to:
- Day yacht charters
- Evening cruises
- Company offsite events
- Exclusive celebrations
- Extended yacht charters
Services are based on vessel availability and weather conditions. We may change or discontinue services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To secure a yacht charter, you're required to:
- Be at least 18 years old
- Submit accurate and complete details
- Make a deposit payment as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
We confirm your booking upon payment reception and issuing a written confirmation. We may decline service to any individual at our discretion.
3.3 Availability
Charter reservations are dependent on the availability of vessels and favorable weather conditions. We make an effort to fulfill your requested dates and timings.
4. Payment Terms
4.1 Pricing
All listed fees are in € and include taxes unless specified differently. Fees are subject to adjustments without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total cost at the time of booking
- Remaining amount: Payable 48 hours before the departure of the charter
- Extra fees (if any): Payable upon charter completion
4.3 Payment Methods
Payments can be made using major credit cards, bank transfers, and certified cheques. We ensure secure and encrypted payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund except for processing costs
- 24 to 72 hours before departure: Refund of 50%
- Under 24 hours before departure: No refund available
5.2 Weather Cancellations
Should the captain deem weather conditions unsafe, we will propose to:
- Reschedule to an alternative date at no added cost
- Process a full refund when rescheduling is not feasible
5.3 Mechanical Issues
Should your assigned vessel encounter mechanical issues, we will strive to offer an appropriate replacement. If no substitute is accessible, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Passengers must adhere to the following:
- Comply with instructions from the crew
- Utilize safety gear as instructed
- Disclose any health conditions that could affect their safety
- Stay within specified areas on the vessel
6.2 Prohibited Items
The items listed below are not allowed on board:
- Glassware
- Illegal substances
- Weapons or firearms
- Excessive beverages beyond reasonable consumption
- Pets, unless they have pre-approval
6.3 Conduct
Guests are expected to behave respectfully. We maintain the right to end a charter prematurely with no refund if a passenger's conduct endangers safety or interferes with the experience of others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is restricted to the amount paid for the charter. We are not liable for:
- Injury due to passenger neglect
- Personal item loss or damage
- Incidental, consequential, or punitive losses
- Delays stemming from weather or factors outside our control
7.2 Insurance Coverage
Our vessels and operations are covered by extensive marine insurance. Passengers should have their own travel and personal insurance.
7.3 Assumption of Risk
By engaging in our charters, you recognize that maritime activities carry certain inherent dangers and you accept responsibility for your own safety and well-being.
8. Modifications and Itinerary Changes
We hold the authority to alter itineraries, paths, or timetables owing to weather considerations, safety, or operational demands. We will make every effort to provide an experience of comparable value.
9. Force Majeure
We shall not be held accountable for disruptions, delays, or changes caused by events outside our control, including but not limited to:
- Extreme weather events
- Natural catastrophes
- Regulatory actions
- Port shutdowns
- Technical failures
10. Privacy and Data Protection
Your private data is managed according to our Privacy Policy. Utilizing our services implies you agree to the collection and use of your information as detailed in our Privacy Policy.
11. Intellectual Property
Copyright and trademark laws protect all material on our website, including texts, designs, logos, and images. Reproducing, distributing, or producing derivative works without our explicit consent is prohibited.
